Welcome to Elmob.ai ("Platform"), operated by Elmob Marketing LLC ("Company," "we," "us," or "our"). By accessing or using this Platform, creating an account, or subscribing to any plan, you agree to be bound by these Terms of Use. If you do not agree, do not use this Platform.

1. Platform Description

Elmob.ai is a cloud-based marketing automation platform for local service businesses and marketing agencies. The Platform provides AI-powered tools including but not limited to: AI Review Management, Google Business Profile Autopilot, Local Rank Tracking, Voice AI Agent, Ad Studio, Content Studio, SMS and Email Marketing, Unified Inbox, Lead Management and CRM, Appointment Booking, Client Reporting, White-Label Reselling, and AI Agent Crews. Services are provided on a subscription basis with a credits-based usage model.

2. Account Registration

To use the Platform, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain the security of your access code and account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.

3. Subscriptions and Payments

The Platform offers tiered subscription plans (Free, Starter, Pro, Agency) with monthly or annual billing. By subscribing to a paid plan, you authorize recurring charges to your payment method. All prices are in US Dollars.

Credits: Each plan includes a monthly credit allocation. Credits are consumed by AI operations, SMS messages, image generation, and other services as described on our pricing page. Unused credits do not roll over.
Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes: We may change subscription pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance.

4. SMS and Voice AI Services (TCPA Compliance)

The Platform includes SMS messaging and Voice AI capabilities powered by third-party telecommunications providers. By using these features, you agree to:

Obtain proper consent from recipients before sending SMS messages or initiating AI voice calls, as required by the Telephone Consumer Protection Act (TCPA) and all applicable federal and state laws
Maintain records of consent for all message recipients
Honor all opt-out requests promptly (STOP, UNSUBSCRIBE, or similar)
Not use SMS or Voice AI for unsolicited commercial messages, spam, or harassment
Comply with A2P (Application-to-Person) messaging guidelines and carrier policies
Accept that voice calls may be recorded for quality assurance and AI training, and that you are responsible for disclosing call recording to callers as required by applicable law

You are solely responsible for ensuring your use of SMS and Voice AI features complies with all applicable telecommunications laws. We are not liable for any claims arising from your failure to obtain proper consent.

5. AI-Generated Content

The Platform uses artificial intelligence to generate content including but not limited to: blog posts, social media posts, ad copy, review responses, email templates, landing pages, and brand profiles. You acknowledge that:

AI-generated content may require human review and editing before publication
We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content
You are responsible for reviewing and approving all content before it is published or sent on your behalf
AI-generated content may occasionally produce inaccurate information or content that does not reflect your business accurately

6. Information Sharing and Referrals

By submitting a quote request, service inquiry, or any contact form on this website, you acknowledge and agree that your submitted information, including but not limited to your name, contact details, project description, and location, may be shared with other vetted local professionals, contractors, or service providers in your area. This referral is made to ensure you receive timely, competitive, and relevant responses to your inquiry.

We do not guarantee the quality, pricing, or availability of any third-party professional to whom your information may be referred. By using this website, you consent to this referral process.

7. Data Ownership and Processing

You retain ownership of all data you upload or input into the Platform ("Your Data"), including client information, leads, reviews, and business data. We process Your Data solely to provide the Platform services. When you use the Platform on behalf of your clients (as an agency), you are responsible for obtaining necessary consents from your clients for data processing.

We may use aggregated, anonymized data for service improvement, analytics, and benchmarking purposes. Such data will not identify you or your clients.

8. White-Label and Reseller Terms

Agency-tier subscribers may resell Platform services under their own brand ("White-Label"). White-label resellers agree to:

Maintain their own terms of service and privacy policies for their end clients
Accept responsibility for their clients' compliance with these Terms
Not misrepresent the capabilities or limitations of the Platform
Ensure data isolation between their clients' accounts

9. API and Integration Usage

The Platform integrates with third-party services including Google (Analytics, Ads, Business Profile), Meta (Facebook, Instagram), Twilio, Stripe, and others. You are responsible for complying with each third-party service's terms of use. We are not liable for changes, outages, or policy updates by third-party providers.

10. Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose
Send spam, unsolicited messages, or violate anti-spam laws
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to other accounts or systems
Reverse engineer, decompile, or disassemble any part of the Platform
Exceed rate limits or abuse API endpoints
Use the Platform to generate content that is defamatory, fraudulent, or misleading

11. Intellectual Property

All Platform technology, design, branding, and proprietary content are the property of Elmob Marketing LLC. You may not reproduce, distribute, or create derivative works without our written consent. AI-generated content created through the Platform for your business use is licensed to you for your commercial purposes.

12. Disclaimers

The Platform is provided "as is" and "as available." We make no warranties regarding uptime, accuracy of AI outputs, or fitness for a particular purpose. Results referenced in marketing materials, case studies, and testimonials are illustrative and do not guarantee similar outcomes. Performance depends on many factors including your industry, location, competition, and effort.

13. Limitation of Liability

To the fullest extent permitted by law, Elmob Marketing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid for Platform services during the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Elmob Marketing LLC from any claims, damages, losses, and expenses arising from: your use of the Platform, your violation of these Terms, your SMS/voice messaging practices, content you publish through the Platform, or your infringement of any third-party rights.

15. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in activities that harm the Platform or other users. Upon termination, you may request an export of Your Data within 30 days.

16. Governing Law

These Terms shall be governed by the laws of the State of Nevada, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in Nevada.

17. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-Platform notification. Continued use after changes constitutes acceptance.
